Executive Employees

The duties tests for the highly compensated executive exemption also require that the employee customarily and regularly perform certain activities.

Customarily and regularly means a frequency that must be greater than occasional but may be less than constant. Tasks performed customarily and regularly include work normally and recurrently performed every workweek; it does not include isolated or one-time tasks.

The employee customarily and regularly performs the following duties (check all that apply):

Management of the enterprise in which the employee is employed or of a customarily recognized department or subdivision thereof.

Directing the work of two or more other full-time employees or their equivalent.

Authorizing the hiring or firing of other employees, or making suggestions and recommendations that are given particular weight regarding the hiring, firing, advancement, promotion or other change of status of other employees.
