Coverage - More on Profit or Non-Profit

If you can’t find out if your enterprise is operated for profit, or if you have questions concerning whether the non-profit enterprise you work for is performing a commercial venture and therefore subject to the $500,000 enterprise sales volume test, please contact your local Wage and Hour Office.

For the purpose of this Advisor, you may wish to assume you work for a private, non-profit enterprise that conducts charitable, educational, or religious activities and therefore you aren’t covered by the FLSA on an enterprise basis. However, you may be individually covered by the law if your own duties meet certain interstate commerce requirements.

Or, you may wish to assume your enterprise is for profit, and continue the Enterprise Coverage section with the test for annual dollar volume.
