All public agencies, including state, local and Federal agencies, are covered by the FMLA irrespective of the number of employees employed.
However, the DOL does not administer the FMLA for all Federal agencies. The DOL administers and enforces Title I of the FMLA, which includes state and local government employees but only certain Federal employees. Most Federal employees, if covered, are covered under Title II of the FMLA, which is administered by the Office of Personnel Management.
