Is My Employer Covered by WARN?

Some public and quasi-public entities are covered by WARN and some are not. Public entities may be covered by WARN if:

  • They are separately organized from the general state and local government structure;
  • They have their own governing bodies;
  • They have independent authority to manage their personnel and assets; and
  • They operate in a commercial context (that is, they sell a product or service to the general public, and they are able to use the money they earn for their own business purposes.)

Commercial activities may include rail passenger service, alcoholic beverage sales, and generation and distribution of electric power.
