How Must Notice Be Given?

If you are entitled to receive individual written notice, your employer may provide the notice to you by any reasonable method of delivery that ensures that you receive the notice at least 60 days before separation. For example, your employer may send you a letter or deliver the letter to you at work or include the notice in your paycheck or pay envelope. However, use of preprinted notices that are regularly included in your paycheck or pay envelope are not acceptable and do not meet the WARN Act requirements. If you are entitled to individual notice, you have a right under WARN to get written notice that gives you information about an actual event that is planned to occur at a definite time. General announcements or notices posted on bulletin boards are not acceptable.

How notice may be served is addressed in Section 639.8 of the WARN regulations and discussed in the Preamble to the 1989 Final Rule.
