  • Guidance for Cases Where the Subject Space Is Not a Confined Space.

Your answers indicate that the subject space is not a confined space.

You are not required to take any action under the terms of OSHA's Permit-Required Confined Spaces rule (29 CRF 1910.146) with respect to this space. You may have other spaces that are confined spaces and some of them may be Permit-Required Confined Spaces subject to OSHA regulations. Use this Advisor program to evaluate each possible confined space in your establishment to determine its status and applicable rules. As an employer you have a due diligence obligation to be aware of the dangers posed by confined spaces and to be alert to identify any confined spaces hazards that may arise in the future and to take appropriate action to protect your workers. If new situations or circumstances arise that suggest the potential for a confined space hazard, re-use this advisor to determine if the requirements of 29 CRF 1910.146 apply or call your OSHA regional office for guidance. Keep in mind that when there are changes in the use or configuration of a non-permit confined space that might increase the hazards to entrants, your obligation is to reevaluate that space and, if necessary, reclassify it as a permit-required confined space.
