OSHA Recordkeeping Advisor

You indicated that:

  • The affected employee was diagnosed with a mental illness but,
  • The affected employee did NOT voluntarily provide the employer with an opinion from a physician or other licensed health care professional with appropriate training and experience (psychiatrist, psychologist, psychiatric nurse practitioner, etc.) stating that the employee has a work-related mental illness.

According to OSHA Regulations 29 CFR 1904.5(b)(2)(ix), this event or exposure appears to be an exception and does NOT have to be recorded.
