In certain situations, the Wage and Hour Division (WHD) has decided not to take a position on whether time spent in certain activities is or is not hours worked. Such an "enforcement policy" is not the law. It means that the WHD, for enforcement purposes only, is not going to treat time spent by employees in certain activities as hours worked. Employees are free to assert that such activity is work time, and are not prevented from doing so by the WHDs enforcement policy.
