FLSA Hours Worked Advisor

For the time spent commuting in your vehicle to not be considered hours worked, the following criteria must be met:

• The vehicle must be of a type normally used for commuting;
• Your employee is able to use his or her normal route for the commute;
• Your employee did not incur any additional costs using your vehicle;
• The home-to-work travel is within your employer's normal commuting area; and
• The use of your vehicle is subject to an agreement between you and your employee (or the employee's representative).
