FLSA Hours Worked Advisor
For the time spent commuting in your vehicle to not be considered hours worked, the following criteria must be met:
- The vehicle must be of a type normally used for commuting;
- Your employee is able to use his or her normal route for the commute;
- Your employee did not incur any additional costs using your vehicle;
- The home-to-work travel is within your normal commuting area; and
- The use of your vehicle is subject to an agreement between you and the employee (or the employee's representative).
