Executive Employees
Because you indicated that the employee neither has the authority to hire or fire other employees nor makes suggestions and recommendations that are given particular weight as to the hiring, firing, advancement, promotion or any other change of status of other employees, the employee does not appear to meet the duties tests for exemption as an executive employee. An employee who does not meet all of the tests for exemption is entitled to the minimum wage and overtime pay protections of the Fair Labor Standards Act (FLSA).
