Professional Employees
Before beginning the analysis of whether the employee meets the duties tests for exemption as a highly compensated learned professional employee, please review the following important definitions:
- Customarily and regularly means a frequency that must be
greater than occasional but may be less than constant. Tasks performed
customarily and regularly include work normally and recurrently performed
every workweek; it does not include isolated or one-time tasks.
- Field of science or learning includes the traditional professions of law, medicine, theology, accounting, actuarial computation, engineering, architecture, teaching, various types of physical, chemical and biological sciences, pharmacy and other similar occupations that have a recognized professional status.
Does the employee customarily and regularly perform one or more duties or responsibilities in a field of science or learning?
