Qualifying Exigencies - Post-Deployment Activities

§ 825.126

What activities qualify for FMLA leave after the military member’s deployment ends?

An eligible employee whose spouse, son, daughter, or parent is a military member may take FMLA leave:

  • To attend arrival ceremonies, reintegration briefings and events, and any other official ceremony or program sponsored by the military for a period of 90 days following the termination of the military member’s covered active duty status; and,
  • To address issues that arise from the death of the military member while on covered active duty status, such as meeting and recovering the body of the military member, making funeral arrangements, and attending funeral services.

Note:

Qualifying exigency leave for post-deployment activities became available to an employee whose spouse, son, daughter or parent is a military member in the National Guard or Reserves on January 16, 2009.

Qualifying exigency leave for post-deployment activities became available to an employee whose spouse, son, daughter or parent is a military member in the Regular Armed Forces on October 28, 2009.
