Qualifying Exigency Leave

§ 825.126

Based on your selections, it appears that the employee requesting leave is not related to the military member on covered active duty as required under the FMLA.

The covered military member must be the spouse, son, daughter, or parent of the employee seeking leave for FMLA qualifying exigency leave. You indicated that the military member is not the employee’s spouse, son, daughter, or parent.
