Selecting a 12-Month Leave Year: Any Fixed 12-Months

Under this method, an employer may select any fixed 12-month period, such as a fiscal year, a year required by state law or a year starting on an employee's "employment anniversary" date.

An employee would be entitled to up to 12 workweeks of FMLA leave at any time in each fixed 12-month period selected. This means an employee could, for example, take 12 workweeks of leave at the end of the leave year and 12 workweeks at the beginning of the next leave year.
