Fair Labor Standards Act Advisor

You are probably covered by the Fair Labor Standards Act (FLSA) in all workweeks since you are engaged on a regular or recurring basis in interstate commerce.

Remember that some employees are exempt from the law's overtime pay provisions, both the minimum wage and overtime pay provisions, and/or child labor rules. Remember that the FLSA applies only to employees. If income taxes are deducted from your pay and you receive a W-2 tax statement from your employer at the end of the year, you are probably considered an employee.
