Based on your responses, the following health laws under Title I of ERISA do not appear to apply to your employer sponsored group health plan for the listed reason(s).
HIPAA requires 2 or more participants who are current employees on the first day of that plan year. However, your state (NAIC) may elect to regulate small groups or individual health arrangements. Plans that are not subject to HIPAA are also not subject to, The Mental Health Parity and Addiction Equity Act (MHPAEA), The Mental Health Parity Act (MHPA) , or The Women's Health and Cancer Rights Act (WHCRA).
MHPA requires that an employer have more than 50 employees on business days during the preceding calendar year and employ at least 2 employees on the first day of the plan year. However, your state (NAIC) may elect to regulate small groups or individual health arrangements |
