FLSA Hours Worked Advisor
Home-To-Work and Return, Emergency Situation
There may be instances when travel from home to work is hours worked. For example, if your employee has gone home after completing his or her day's work and is subsequently called to travel a substantial distance to perform an emergency job at one of your customers' work sites; all time spent on such travel is hours worked.
As an enforcement policy, the Wage and Hour Division will take no position on whether travel time is hours worked when your employee is called back to his or her regular place of work in an emergency, outside his or her regular hours of work.
