Military Caregiver Leave - Current Member of the Armed Forces

ยง 825.127

You indicated that the servicemember is a current member of the Armed Forces, including the National Guard or Reserves.

To take FMLA military caregiver leave to care for a servicemember, the servicemember must be a "covered servicemember," which means he or she is either:

  • undergoing medical treatment, recuperation, or therapy for a serious injury or illness; or
  • in outpatient status for a serious injury or illness; or
  • on the temporary disability retired list for a serious injury or illness.
