An employer may seek authentication and/or clarification of a completed WH-385-V (or other form used to certify military caregiver leave) or the documentation indicating a servicemember’s enrollment in the Department of Veterans Affairs Program of Comprehensive Assistance for Family Caregivers under the same guidelines as those provided for medical certification. An employer may require an employee to provide confirmation of the covered family relationship the employee has to the seriously injured or ill veteran (including for leave supported by the documentation indicating a veteran’s enrollment in the Department of Veterans Affairs Program of Comprehensive Assistance for Family Caregivers).
