Employee Eligibility - How does an employee become eligible to take FMLA leave?

The benefits and protections of the FMLA apply only to eligible employees of covered employers. We can now determine eligibility for an employee whose employer is covered by the FMLA.

How long has the employee worked for the employer?

Notes:

The 12 months do not have to be consecutive.
Special rules apply to employees returning from service covered by the Uniformed Services Employment and Reemployment Rights Act.
